"Wife Swap" Child Alicia Guastaferro Sues ABC For $100 Million

AMHERST, NY (WGRZ) -- Alicia Guastaferro, 18 of Amherst, who appeared on the ABC reality show "Wife Swap" more than two years ago is now suing the network for $100 million.
Guastaferro was portrayed as a "spoiled brat" beauty queen on the show, and her suit alleges the show was staged. As a result of the episode, she claims she suffered panic attacks and was even forced to transfer schools due to the ridicule.
2 On Your Side obtained a copy of the lawsuit, which was filed in New York State Supreme Court in Manhattan.
Attorney David Retner said his client is seeking $100 million to compensate her for her pain and suffering and to punish the producers of the show to prevent such unfair treatment from happening to another child.
This lawsuit was filed by Alicia and not her parents, who both pleaded guilty to federal money laundering charges.
Western New York Attorney Frank LoTempio III says Disney will likely use the defense that Karen Guastaferro signed up for the show and signed consent for her daughter to be featured. LoTempio says Disney will also point to the fact that while they may have asked the cast to "re-take" some shots, if there is no formal script, there's no way to prove Guastaferro was acting.
LoTempio says once the trial begins, it's likely Guastaferro's medical records will be used in court as a way to prove pain and suffering. If the case goes to trial, LoTempio says it could take 5 to 6 years to complete. He also says, there's a good chance it could and should be settled out of court.
2 On Your Side went to the Guastaferro's home in Amherst but no one answered. Disney/ABC have no comment at this time.
